How to sign a will in Oklahoma
- Print your will and read every word. Fill in any blanks in ink, but don't sign yet.
- Choose two adult witnesses who receive nothing under your will and aren't married to anyone who does.
- Sign and date your will in front of both witnesses, at the same time. Then each witness signs while you and the other witness watch.
- Make it self-proving. You and your witnesses sign a short self-proving affidavit in front of a notary, so the court won't need to find your witnesses later. (84 O.S. 55(5)-(7): either an acknowledgment and witness affidavits before an officer, or written declarations under penalty of perjury with no notary (both forms in statute); for electronic wills, 84 O.S. 907)
- Store the original safely and tell your executor where it is. Oklahoma also lets you deposit your will with the probate court for safekeeping.
Who can make a will
Anyone 18 or older and of sound mind.
Witness rules
The testator must subscribe at the end of the will in the witnesses' presence, or acknowledge the signature to them, and must declare to them that the instrument is the testator's will. Each witness signs at the end, at the testator's request and in the testator's presence. The statute has no each-other presence rule. Witnesses should write their residence, but omitting it does not invalidate the will (84 O.S. 55, 56).
If a witness inherits: A gift to a subscribing witness is void unless there are two other competent subscribing witnesses; the witness still takes up to their intestate share (84 O.S. 143-144).
Handwritten wills
Entirely written, dated, and signed by the testator's own hand; no witnesses needed (84 O.S. 54).
Self-proving affidavit
Oklahoma lets you and your witnesses sign a self-proving affidavit, so the court can accept your will without contacting your witnesses. (84 O.S. 55(5)-(7): either an acknowledgment and witness affidavits before an officer, or written declarations under penalty of perjury with no notary (both forms in statute); for electronic wills, 84 O.S. 907)
Can I sign my will online in Oklahoma?
Yes, electronic wills are allowed. Two witnesses may sign in the testator's physical or electronic presence (real-time audio-video). Each witness must be a resident of a U.S. state and physically located in a state when signing. Anyone signing for the testator must be in the testator's physical presence. The act applies to decedents dying on or after Nov. 1, 2024 (84 O.S. 905, 910). (84 O.S. 901-910 (Oklahoma Uniform Electronic Estate Planning Documents Act; Laws 2024, c. 344))
In effect since 2024-11-01.
Online notarization: For electronic wills, the self-proving acknowledgment and affidavits may be made before an officer under the Oklahoma Remote Online Notary Act (84 O.S. 907(B)(1)). Paper wills can instead be self-proved by unsworn declarations, with no notary at all. (49 O.S. 201-214 (Remote Online Notary Act; Laws 2019, c. 338), effective 2020-01-01)
Online notary services such as Proof can host a signing session with a notary and, for a fee, witnesses (published prices start at about $25 per notarization plus $15 per witness). Before you sign, confirm the service supports will signings under Oklahoma law, and keep the signed original as the law requires. How online will signing works.
